Terms of use

These terms govern the use of animatio.app and of the sign-up for updates about Animatio. They apply to anyone who uses the site. They are not terms of sale: Animatio is not on sale yet. This is a translation for convenience: if the two versions differ, the Italian version prevails.

In these terms “we” means M's Works; “you” means whoever uses the site.

02What this site is

animatio.app presents Animatio, the motion graphics software by M's Works for computers (Windows, Mac and Linux), and lets you sign up for updates.

Animatio is in development and not on sale yet. Today there are no release dates, licences or public downloads.

03Information about Animatio

The features, platforms, images and animations you see describe the product as we are building it. They are indicative and may change until release: a feature may change, arrive later or not be there.

This is not an offer. Nothing you read on the site is an offer to the public (Art. 1336 of the Italian Civil Code) or a promise of sale or date. Nothing can be bought on the site.

When Animatio goes on sale there will be separate terms of sale and a licence agreement. You will read and accept them before buying, and they, not these terms, will govern the purchase and use of the program.

04Signing up for updates

  • It is free.
  • It does not oblige you to buy anything and does not reserve any date or availability for you.
  • We write to you only about Animatio: release, availability, product news.
  • You can unsubscribe whenever you want, with the link at the bottom of every email.
  • You must be at least 14.
  • Only sign up an email address that is yours.

We may suspend or close the updates service. If we close it, we delete the addresses as explained in the privacy policy, which also says how we handle your email. You sign up from the form on the home page.

05Brand and content

The Animatio name, the logo, the texts, images, animations and code of the site belong to M's Works, or to whoever licensed them to us, and are protected by law.

You may view them, share links to the pages and quote short parts with the source. Without our written permission you may not copy, modify or use them for other products or services, or use the Animatio name or logo in a way that makes it look as if we are the ones speaking.

06How you may use the site

You may use the site to learn about Animatio and to sign up for updates. You may not:

  • sign up other people's email addresses or made-up addresses;
  • send automated or bulk requests to the form, or try to get around the anti-abuse limits;
  • try to access parts of the site or systems that are not public, or to disrupt how they work;
  • extract content in bulk with automated programs, except for search engine indexing.

If you break these rules, we may block your requests and delete your sign-up.

08Liability

The site is free and meant to inform. We keep it up to date and working with care, but it may be slow, unreachable for a while, or a piece of information may be out of date.

To the extent permitted by law, we are not liable for damage caused by interruptions of the site or by decisions made relying on information about a product that has not been released yet.

What we do not exclude. These limits do not apply if the damage is caused by our wilful misconduct or gross negligence (Art. 1229 of the Italian Civil Code), or in other cases where the law does not allow liability to be limited. If you are a consumer, all the rights the Italian Consumer Code gives you remain unaffected.

09Changes to these terms

We may update these terms, for example when the site or the law changes. The version in force is always on this page, with the date at the top. If a change significantly affects the sign-up for updates, we will tell you by email.

If a clause turns out to be invalid, the others remain in force.

10Governing law and jurisdiction

Italian law applies. If you are a consumer living in another country of the European Union, the mandatory consumer protection rules of your country remain unaffected.

If you are a consumer, any dispute falls under the court of the place where you reside or are domiciled (Art. 66-bis of the Italian Consumer Code).

If you use the site for your professional or business activity, the Court of Palermo has jurisdiction.
